Adjustment of Status (AOS) – Apply for a Green Card Without Leaving the U.S.

Adjustment of Status (AOS) is the process that allows eligible non-U.S. citizens to apply for a Green Card (lawful permanent residence) while remaining in the United States. This process is overseen by U.S. Citizenship and Immigration Services (USCIS) and is an alternative to consular processing, which requires applicants to apply from outside the U.S.

If you meet the eligibility requirements, you can apply for permanent residency through Adjustment of Status without having to return to your home country.

Who is Eligible for Adjustment of Status?

You may qualify for Adjustment of Status if you are already lawfully present in the U.S. under an eligible immigration category. The most common eligibility categories include:

Family-Based Green Card Applicants

You may apply for Adjustment of Status if you are:
 -  Married to a U.S. citizen or Green Card holder
 -   The child (under 21 and unmarried) of a U.S. citizen
 -   The parent of a U.S. citizen (if the citizen is 21 or older)
 -   A sibling of a U.S. citizen (if the citizen is 21 or older)

 Immediate relatives of U.S. citizens (spouses, parents, and unmarried children under 21) do not have to wait for a visa number – they can apply immediately!

 

Refugees & Asylees

 -   If you were granted asylum or refugee status in the U.S., you may apply for a Green Card one year after receiving asylum or refugee status.

 Special Immigration Categories

Other eligible applicants include:
 -   Fiancé(e)s of U.S. citizens who entered on a K-1 visa
 -   Individuals under humanitarian programs, such as Temporary Protected Status (TPS)
 -   Cuban Adjustment Act applicants
