Work Permit (Employment Authorization Document - EAD) 

A Work Permit, officially known as an Employment Authorization Document (EAD), allows non-U.S. citizens to legally work in the United States. If you are in the U.S. under certain immigration categories, you may be eligible to apply for an EAD. This document is issued by U.S. Citizenship and Immigration Services (USCIS) and is typically valid for one to two years, depending on your immigration status.

Categories of People Eligible for a Work Permit (EAD)

Pending Green Card Applicants (Adjustment of Status - Form I-485)

If you have applied for a Green Card (lawful permanent residency) and your case is still pending, you can apply for an EAD. This allows you to work legally while waiting for USCIS to make a decision on your adjustment of status.

 - Eligibility Requirements:

  • Must have a pending Form I-485 (Application to Register Permanent Residence or Adjust Status).
  • Can apply for an EAD along with Form I-485 or afterward.

Temporary Protected Status (TPS) Holders

Foreign nationals from designated TPS countries can apply for a work permit while in the U.S.

- Eligibility Requirements:

  • Must have an approved TPS designation.
  • Can apply for an EAD as long as TPS is valid.

DACA (Deferred Action for Childhood Arrivals) Recipients

Individuals who arrived in the U.S. as children and are protected under DACA can apply for a work permit.

Eligibility Requirements:

  • Must have an approved DACA application.
  • EAD must be renewed every two years.

 Asylees and Refugees

Those who have been granted asylum or refugee status in the U.S. are eligible to work.

Eligibility Requirements:

  • Approved Asylees & Refugees: Can work without an EAD but may apply for one if needed.
  • Asylum Applicants with Pending Cases: Can apply for an EAD 150 days after filing Form I-589.

    Renewing Your Work Permit (EAD)

    - If your current EAD is about to expire, you can apply for renewal before it runs out.
    - Submit Form I-765 for renewal at least 180 days before expiration to avoid work interruptions.
    - Renewal EADs are typically valid for one to two years, depending on your eligibility.
