Marriage-Based Green Card

A marriage-based green card allows the spouse of a U.S. citizen or lawful permanent resident to live and work in the United States as a permanent resident. This process involves proving that your marriage is genuine and completing the necessary legal steps to obtain a green card.

Who is Eligible?

You may qualify for a marriage-based green card if:
 - You are legally married to a U.S. citizen or a lawful permanent resident (green card holder).
 - Your marriage is bona fide (real) and not solely for immigration benefits.
 -  Your U.S. citizen or green card holder spouse is willing to sponsor you.
 -  You do not have a history of serious criminal offenses or immigration violations.

Forms Required for a Marriage-Based Green Card

 - Form I-130 – Petition for Alien Relative (filed by the U.S. citizen or green card holder spouse).
 - Form I-485 – Application to Register Permanent Residence or Adjust Status (if applying from within the U.S.).
 - Form DS-260 – Immigrant Visa Application (if applying from outside the U.S. via consular processing).
 - Form I-864 – Affidavit of Support (proving financial sponsorship by the U.S. spouse).

 - Work Authorization & Travel Permit (Optional) – If applying from within the U.S., you may file Form I-765 (work permit) and Form I-131 (travel document) along with Form I-485.

 - USCIS Processing & Biometrics Appointment – USCIS will schedule a fingerprinting appointment to verify your identity and background.

 - Green Card Interview

  • If applying from inside the U.S., both spouses will attend an interview at a USCIS office.
  • If applying from outside the U.S., the foreign spouse will attend an interview at a U.S. consulate or embassy.

 - Decision on Your Case

  • If approved, the foreign spouse will receive a conditional or permanent green card.
  • If denied, USCIS may request more evidence or issue a denial.

 - Conditional Green Card (If Married Less Than 2 Years) – If your marriage is less than two years old at the time of approval, you will receive a 2-year conditional green card.

 - Removal of Conditions (Form I-751) – After two years, you must file Form I-751 to prove your marriage is still genuine and receive a 10-year permanent green card.

 - Apply for U.S. Citizenship (Optional) – After three years of holding a marriage-based green card, you may be eligible to apply for U.S. citizenship (Form N-400).
